Background

Environmental Planning and Assessment Amendment (Fire Safety and Building Certification) Regulation 2017 commenced 1 October 2017. It made changes to the EP&A Regulations, of note is Clause 167A.
 
Clause 167A (4) (a) requires that until an order is published identifying who are accredited/licenced to be Competent Fire Safety Practitioners (CFSP), then an assessment is to be made by the relevant Certifying Authority(CA) or Principal Certifying Authority(PCA), to confirm in writing that the person is competent to perform the fire safety assessment functions listed as being undertaken by a CFSP in the Environmental Planning and Assessment Regulation 2000. This relates to persons preparing the design and specifications for proposed building works in the following areas:
  • Design of Hydraulic fire safety system/s within the meaning of Clause 165 of the EP&A Regulation (Fire Hydrants, Fire Hose Reels, Sprinkler Systems (including wall wetting sprinkler or drenchers systems), or any type of automatic fire suppression system of a hydraulic nature).
  • Design of Fire Detection and Alarm system/s
  • Design of Mechanical ducted smoke control system/s
  • Fire Safety Engineering Performance Solutions  
 The requirement for this assessment becomes mandatory for any DA application lodged after 1 October 2017, and any CDC application lodged after 1 October relating to Class 2-9 buildings in New South Wales (Schedule 7 of EPA Regulation 2000).
